Electrocution Claims in Stockton
Representation Focused on Injured Stockton Workers
Electrical accidents at work can lead to workers’ compensation claims and, when someone outside the employer contributed, a separate civil claim. At Rancaño & Rancaño, APLC, we represent Stockton workers injured by live wiring, power lines, defective equipment, and other electrical hazards.
We’ve represented injured workers across all industries since 1989. Workers’ compensation is generally a no-fault system, so employees hurt while performing their duties can qualify even when their own mistakes contributed to the accident. We represent injury victims, not employers or insurance institutions.
Call (888) 859-7022 for a free consultation about an electrocution or electric shock workers’ compensation claim in Stockton. You won’t be required to sign a contract during the consultation.
Electrical Hazards on Stockton Worksites
Electrocution is death caused by electrical current. A nonfatal electric shock can still cause burns, cardiac complications, nerve damage, and other serious conditions. Workers with frequent exposure include electricians, line workers, and construction workers.
Accidents may arise from assigned duties, worksite conditions, tools, or nearby equipment. Common hazards include overhead power lines, exposed wiring, and faulty machinery. An incident involving one of these conditions may qualify for benefits when it occurs in the course of employment.
Starting an Electric Shock Workers’ Compensation Claim
A worker generally doesn’t have to prove that an employer caused a work-related electrical injury. The immediate priorities are obtaining appropriate care and documenting the accident through the required reporting and claim procedures.
A worker who needs treatment beyond first aid must notify the employer in writing within 30 days or risk losing benefits. After learning of an occupational injury or illness, the employer must provide a DWC-1 claim form within one working day. The worker uses this form to begin the formal workers’ compensation process.
Once the worker completes and returns the form, the claims administrator decides whether to accept or deny the claim. If the administrator does neither within 90 days, the injury is presumed work-related. While the decision is pending, up to $10,000 in medical treatment is available under applicable guidelines.
Benefits Available After an Electrical Injury
Available benefits depend on the care required, time missed from work, lasting impairment, and whether the employee can return to the same occupation.
Depending on the facts and medical findings, benefits can include:
- Emergency care, burn treatment, cardiac testing, neurology care, and other necessary medical treatment
- Temporary disability benefits during an eligible period away from work
- Permanent disability benefits for lasting impairment
- Supplemental job displacement benefits for qualifying retraining expenses
- Death benefits for eligible dependents after a fatal electrocution
Workers’ compensation covers necessary medical care at 100 percent. Temporary disability payments generally equal two-thirds of gross, pre-tax lost wages, subject to the maximum weekly amount established by law. For most injuries, payments can continue for up to 104 weeks within five years.
Some qualifying long-term injuries, including severe burns, can receive disability payments for up to 240 weeks within five years. Workers’ compensation doesn’t award pain and suffering damages, but those damages may be available through a separate personal injury claim.
Claims Against Third Parties After Workplace Electrocution
Workers’ compensation generally prevents employees from suing their own employers for workplace injuries. It doesn’t necessarily eliminate a claim against a separate person or company whose conduct or product contributed to the accident.
A responsible third party might be a property owner, general contractor, equipment manufacturer, utility, or another non-employer. California Labor Code section 3852 allows an employee to pursue damages from a responsible third party. Because we handle workers’ compensation and personal injury claims, we can assess whether both avenues apply to the same incident.
Guidance Through Filing, Appeals & Hearings
We guide clients through filing and respond when benefits are delayed, disputed, or denied. The claims administrator conducts the initial review. If the parties can’t resolve a dispute, it may proceed through the California Division of Workers’ Compensation hearing process.
The former Stockton district office relocated in December 2023 and is now the Lodi district office. We account for the correct hearing jurisdiction while managing the procedural steps in a disputed claim. Our Stockton team also provides prompt updates so clients know where their cases stand.
Discuss Your Electrical Accident Without Upfront Fees
A free consultation allows you to discuss the accident, your employment, the care you’ve received, and the status of any DWC-1 form without committing to representation. We work on a contingency fee basis, so no legal fees are charged until compensation is recovered.
Stockton workers and families can use our contact us page to share information about a workplace accident. We can evaluate whether workers’ compensation, a claim against an outside party, or both may apply.
